      <![CDATA[IVA stands for Individual Voluntary Arrangement.

An Individual Voluntary Arrangement, or IVA, is a <strong><i>formal</strong></i> debt solution which is designed to assist a person who is struggling with unaffordable personal repayments.

The IVA does this by restructuring the expected repayments to a new affordable monthly payment, thus helping the debtor to keep up to date with the priority expenses, such as <strong><a href="http://www.myiva-adviser.com/blog/iva-what-is-secured-debt.php">secured</a></strong> loans - like a mortgage or rent payment, and essential living cost - without the fear of legal recovery action being taken against them by their <a href="http://www.myiva-adviser.com/blog/iva-what-is-an-unsecured-debt.php"><strong>unsecured</strong></a> creditors.

      <![CDATA[Because the IVA is a formal arrangement, it protects both parties from trying to make adjustments to the arrangement after it has been agreed.

An IVA will also stop a debtor being harassed by their creditors. This is because one of the fundamental terms of the IVA stops creditors from contacting the debtor directly, once the IVA has begun, and all correspondence must be through an <strong><a href="http://www.myiva-adviser.com/blog/iva-the-role-of-the-insolvency-practitioner.php">insolvency practitioner</a></strong>. The insolvency practitioner is chosen by the debtor to assist with the <strong><a href="http://www.myiva-adviser.com/blog/iva-what-is-an-iva-proposal.php">IVA proposal</a></strong>, and the insolvency practitioner oversees or supervises the IVA for its full term.

An IVA will under normal conditions last for a term of 5 years, after which time the debtor will be considered debt free, even if they have not been able to repay the full original level of debt.

An IVA is especially suitable when the debtor has a property they need to protect from their unsecured creditors. This is because once the IVA has been agreed, and so long as the debtor  adheres to the IVA terms, the unsecured creditors are unable to force the sale of the property, instead they settle for as much <strong><a href="http://www.myiva-adviser.com/blog/equity-ivas.php">equity</a></strong> as can be released via a standard remortgage. 

The IVA is also extremely suitable as a debt solution when the debtor has an occupation which would be put at risk should the debtor be made bankrupt. Professional occupations such as accountants or legal professionals, or indeed an occupation where there is deemed to be a high level of responsibility or trust such as a Police Officer, someone in the armed services or a bank employee, all find themselves protected by an IVA, and it is a real alternative debt solution to bankruptcy.

An IVA is also a private arrangement betweeen the debtor and the creditors, and although it will appear on the IVA register, it is not made public which is not the case in bankruptcy.

      As the debate over the suitability of Individual Voluntary Arrangements (IVAs) as an appropriate debt solution rages on, people with serious debt problems are finding themselves being torn over the mixed messages within the advice they are receiving.

This article hopes to help people who have equity in their property come to understand how their equity will be effected before,  during,  and after an Individual Voluntary Arrangement (IVA), in cases where an Individual Voluntary Arrangement (IVA) is the debt solution they use to become debt free.
      <![CDATA[To be able to understand how creditors view an Individual Voluntary Arrangement (IVA) proposal you must try to approach the situation from their stand point.

Creditors all have the opinion that a debtor should repay as much of their debt as possible. This means that, as far as they are concerned, all the assets of a debtor are subject to scrutiny.

In a bankruptcy, a person's assets (including equity in a home) are made available to the creditors. Because an Individual Voluntary Arrangement (IVA) needs to be a stronger offer to creditors than bankruptcy, it is understandable that in an Individual Voluntary Arrangement (IVA) proposal creditors would expect to see an effort to release any equity that is available. 

This would normally be via a <strong><a href="http://www.myiva-adviser.com/blog/iva-how-will-an-iva-affect-the-equity-in-my-house.php">re-mortgage</a></strong>. 

However, it is also true that someone who is in an Individual Voluntary Arrangement (IVA) will not be able to release as much equity in a re-mortgage as someone who has a clean credit history, and our experience tells us that normally a person in an Individual Voluntary Arrangement (IVA) could expect to raise only 75% - 80% of the equity within their home.

This amount equity would usually be expected to be raised at the end of the fourth year, and would generally bring the Individual Voluntary Arrangement (IVA) to a early close. If the amount of equity available for release was insignificant, or the extra borrowings made the cost of the re-mortgage unaffordable, then the creditors would consider continuing with the Individual Voluntary Arrangement (IVA) in the normal way until the end of the fifth year. At which time there would be a reassessment of the conclusion of the Individual Voluntary Arrangement (IVA) and may even not involve the equity at all.

But what happens when one of the debts is owed to the Student Loan Company?
      <![CDATA[When debt repayments become too difficult to afford, often a person will take out further credit to cover the repayments, and thus find  their situation worsening.

This is where an <strong><a href="http://www.myiva-adviser.com/iva.php">Individual Voluntary Arrangement (IVA)</a></strong> can help. 

An IVA) is a new agreement with existing creditors. Monthly debt repayments are  replaced with one monthly contribution into the IVA fund. The contributions to the IVA fund continue for the duration of the IVA, normally 60 months, after which time the debts will be considered settled. (If there is any debt not fully repaid through the IVA, the creditor concerned will be required to write off the remainder.)

<h4 align="center"> Student Loans Background.</h4>

After the introduction of the Enterprise Act in 2004, (where several amendments were made to the bankruptcy laws, which among other things, reduced the term of a bankruptcy to 12 months.) more and more students recognized the advantages of declaring themselves bankrupt to enable themselves to 'clean the financial slate' before commencing with the rest of their lives. 

However, due to the sheer amount of graduates opting for the bankruptcy solution, the government made further changes and loans owed to The Student Loan Company were deemed no longer a provable debt in a bankruptcy.
